Welcome to PickLog! This document outlines the terms and conditions governing your use of the PickLog mobile application ("App") and its associated services, as well as our policies for handling your data.

Please read these Terms of Service and Privacy Policy carefully before using the App. By downloading, accessing, or using the App, you agree to be bound by these terms. If you do not agree to these terms, do not use the App.

Terms of Service

1. Acceptance of Terms

The "PickLog" app ("App") is a tool for creating, managing, and sharing shopping lists. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and Tugriink ("Company," "we," "us," or "our"). By using the App, you agree to these Terms and all applicable laws and regulations.

2. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE COMPANY PROVIDES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

The Company makes no warranties regarding the accuracy, completeness, reliability, or timeliness of any content or data within the App. You assume all risks associated with your use of the App.

3. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP; (iii) ANY CONTENT OBTAINED FROM THE APP; AND (iv) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

4. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

• Reverse engineering, decompiling, disassembling, or otherwise attempting to discover the source code of the App.
• Introducing any viruses, malware, or other harmful code into the App.
• Infringing upon the intellectual property rights, privacy rights, or any other rights of the Company or third parties.
• Uploading, posting, or sharing content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Using the App for any illegal purpose or in violation of any applicable local, state, national, or international law.
• Collecting or harvesting any personally identifiable information from the App without our express permission.
• Interfering with or disrupting the integrity or performance of the App or the data contained therein.

5. User-Generated Content and Responsibility

You are solely responsible for all content you create, store, or share through the App ("User Content"). You represent and warrant that you own or have the necessary licenses, rights, and permissions to use and share your User Content. You agree that your User Content will not infringe upon the rights of any third party, including copyright, trademark, privacy, or publicity rights.

The Company assumes no responsibility for the User Content and disclaims all liability for any damages or losses arising from such content. We reserve the right, but are not obligated, to remove or modify any User Content that we, in our sole discretion, deem to be in violation of these Terms.

6. Intellectual Property Rights

The App and all of its original content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are and will remain the exclusive property of the Company and its licensors. The App is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of the Company.

7. Termination of Service

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App will cease immediately.

You can also delete your account at any time as described in the Privacy Policy.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state and federal courts located in Santa Clara County, California.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to notify you by posting the new terms on this page, and we may also provide notice through an in-app message, email, or other direct communication. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.

10. Use by Minors

The App is not intended for use by children under the age of 13. By using the App, you represent that you are at least 13 years old. If you are a minor between the ages of 13 and 18, you must obtain the consent of your parent or legal guardian to use the App.

Privacy Policy

This Privacy Policy explains how Tugriink ("we," "us," or "our") collects, uses, and discloses information from you when you use the PickLog mobile application ("App").

By using the App, you consent to the collection, use, and disclosure of your information as described in this Privacy Policy.

1. Information We Collect

We may collect the following types of information:

• User-Provided Information: Shopping lists, items, and notes you create and save in the App. **Image Data (photos, media files, etc.) uploaded by the user to be attached to memos.** This data is stored on a Google Firebase database and is associated with an anonymous user ID for family sharing purposes.
• Device and Usage Information: We may automatically collect certain information about your device and how you use the App, such as device type, operating system, unique device identifiers, IP address, and usage patterns (e.g., features used, frequency of use). This data is typically anonymized and aggregated.
• Third-Party Analytics: We may use third-party analytics services to help us understand how our users engage with the App. These services may collect information about your use of the App to generate reports and metrics.

2. How We Use Your Information

We use the collected data for the following purposes:

• To provide, maintain, and improve the App's functionality, including saving, displaying, and managing your shopping lists.
• To enable the family sharing feature, allowing you to share lists with designated users.
• To analyze usage trends and personalize the user experience.
• To create aggregated and anonymized statistical data for marketing, research, and business purposes.
• To respond to your inquiries and provide customer support.
• To comply with legal obligations and protect our rights.

3. How We Share Your Information

We may share your information in the following circumstances:

• With Your Consent: When you use the sharing feature, the memo data you choose to share will be visible to the family members you have designated.
• Service Providers: We use third-party service providers, such as Google Firebase, to host and manage your data. These providers are bound by their own privacy policies and are required to protect your information. For Google's privacy policy, please refer to https://policies.google.com/privacy.
• Legal Requirements: We may disclose your information if required to do so by law or in the good faith belief that such action is necessary to comply with a legal obligation or protect the rights, property, or safety of the Company, our users, or the public.
• Anonymized Data: We may share aggregated and anonymized data with third parties for analytics, research, or business purposes. This data does not personally identify you.

4. Your Rights and Choices

You have the following rights regarding your information:

• Access and Correction: You may have the right to access the personal information we hold about you and to request that we correct any inaccurate information.
• Deletion: You can delete your account at any time as described below. This will permanently delete all associated data.
• Opt-Out: You may be able to opt-out of certain data collection by adjusting your device settings, though this may affect the functionality of the App.

5. Account Deletion

You can permanently delete your account and all associated data, including shopping list memos and group information stored on our servers, by navigating to the menu (hamburger icon) in the top-right corner of the App and selecting "Delete Account" at the bottom. Once deleted, this data cannot be recovered.

6. Security

We implement reasonable security measures to protect your information from unauthorized access, alteration, disclosure, or destruction. We utilize security features provided by our service providers, such as Google Firebase, to protect data at rest and in transit.

7. Changes to this Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page, and we may also provide notice through an in-app message, email, or other direct communication. By continuing to use the App after any changes become effective, you agree to the revised Privacy Policy.
